Terms of Service — Lingueez

These Terms govern your use of the Lingueez desktop application and the optional hosted sync service. By creating an account or using the sync service you agree to these Terms. A Ukrainian version is available here.


1. The service

Lingueez is a desktop application for studying vocabulary across languages. It can be used locally without an account. If you create an account, an optional hosted sync service stores your content in the cloud so you can use it across devices.

The service is provided by Lingueez (“we”, “us”); see the contact details below.

2. The software licence

The Lingueez application is free and open-source software, licensed under the GNU Affero General Public License v3.0 (AGPL-3.0), with additional terms under AGPL §7 (see the LICENSE.txt and NOTICE files distributed with the app). These Terms govern the hosted sync service; the AGPL governs your rights in the software itself. Where they overlap, the AGPL prevails for the software.

3. Your account

  • You must be at least 13 years old to create an account (and old enough to do so under the law of your country/state).
  • You are responsible for keeping your credentials secure and for activity under your account.
  • Provide accurate information (a valid email) so we can deliver account-related messages.

4. Acceptable use

You agree not to:

  • use the service unlawfully, or to store or transmit unlawful content;
  • attempt to access other users’ data, or to break the per-user isolation of the service;
  • overload, disrupt, attack, or reverse-engineer the hosted infrastructure (note: this does not restrict your AGPL rights regarding the software, which you may freely study and modify);
  • use the service to infringe others’ rights.

We may suspend or terminate accounts that violate these Terms.

5. Your content

You keep all rights to the content you create (your words, texts, tags). You grant us only the limited technical permission needed to store, back up and sync that content to provide the service. We do not claim ownership and do not use your content to train models or for advertising.

6. Optional third-party features

The app can connect to third-party services (translation, text-to-speech, AI, dictionary/web lookups). Some require your own API key and are subject to those providers’ own terms and privacy policies. The default free translation/read-aloud sends the text you translate or play to Google’s free endpoints; see the Privacy Policy for details and how to switch providers.

7. Availability — no warranty

The service is provided free of charge and “as is” and “as available”, without any warranty of any kind to the extent permitted by law. We do not guarantee that the service will be uninterrupted, error-free, or that data will never be lost — keep your own backups (the app makes local backups automatically and offers export).

8. Liability

To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising from your use of (or inability to use) the service. Because the service is provided free of charge, our total liability for any claim relating to the service is limited to the amount you paid for it (i.e. nothing).

Nothing in these Terms excludes liability that cannot be excluded under applicable law (for example, for fraud, willful misconduct, or gross negligence). Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

9. Termination

You may stop using the service and delete your account at any time from within the app (“Delete account”). We may suspend or end the service, or your access, for the reasons above or if we discontinue the service; where feasible we will give reasonable notice so you can export your data.

10. Changes to these Terms

We may update these Terms. Material changes are indicated by the Version and date above, and you may be asked to re-accept them in the app. Continued use after changes take effect constitutes acceptance.

11. Governing law

These Terms are governed by the laws of the State of Delaware, USA, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. Any mandatory consumer-protection rights you have under the law of your own country or state remain unaffected.
